ORDER FILED. The district court entered judgment on February 11, 2015. It appears that this appeal filed on March 25, 2025 may be frivolous, and limited in scope to a review of the district courts March 11, 2025 order denying appellants February 18, 2025 motion for relief from judgment. See 28 U.S.C. 2107(b); Fed. R. App. P. 4(a)(1)(B); United States v. Sadler, 480 F.3d 932, 937 (9th Cir. 2007) (requirement of timely notice of appeal is jurisdictional). If the appeal is frivolous, the court will deny permission to proceed in forma pauperis and dismiss the appeal. See 28 U.S.C. 1915(e)(2). Within 35 days, appellant must: (1) file a statement explaining why the appeal is not frivolous and should not be limited in scope to a review of the district courts March 11, 2025 post-judgment order, OR (2) file a motion to voluntarily dismiss the appeal, see Fed. R. App. P. 42(b). The court will determine whether the appeal is frivolous based on appellants statement in response to this order, if any, and the opening brief submitted May 6, 2025. If it is frivolous, the appeal will be dismissed. If it is not frivolous, the appeal will proceed. Because there are no appearances for appellee, briefing is complete.
