HURWITZ This court holds this appeal in abeyance to allow Plaintiff/Appellant Can- Am Fuel Distribution, LLC, to move promptly in the district court for entry of an interlocutory order under 28 U.S.C. 1292(b) with respect to the district courts dismissal under Federal Rule of Civil Procedure 12(b)(6) of Can-Ams claim for relief under the Petroleum Marketing Practices Act, 15 U.S.C. 2801 et seq. See district court order of February 25, 2025. Entry of an order by the district court under 1292(b) will allow this court to facilitate the efficient management of the case now before the district court.
