The court lacks jurisdiction over this appeal, because the district courts order denying defendants motion to dismiss or remand plaintiffs claims is not immediately appealable under the collateral order doctrine. See Digit. Equip. Corp. v. Desktop Direct, Inc., 511 U.S. 863, 867-68 (1994) (discussing collateral order doctrine requirements and explaining that they are stringent). Appellants request to treat the notice of appeal as a petition for writ of mandamus is denied because appellants do not demonstrate that this case warrants the intervention of this court by means of the extraordinary remedy of mandamus.
