ORDER FILED. Sidney R. THOMAS The request for a certificate of appealability is granted with respect to the following issues: whether appellate counsel was ineffective for failing to raise claims that: (1) the prosecutor substantially interfered with the ability of appellant to call G.H. as a witness in the third trial, in violation of appellants right to present a complete defense, and (2) appellant was denied his right to confrontation because he was precluded from questioning G.H. about the nature of or facts underlying his prior convictions. See 28 U.S.C. 2253(c)(3); see also 9th Cir. R. 22-1(e). The opening brief is due January 6, 2026. The answering brief is due February 5, 2026. The optional reply brief is due 21 days after the answering brief is served. The clerk will serve on appellant the After Opening a Case Counseled Cases document. If Ryan Thornell is no longer the appropriate appellee in this case, counsel for appellee must notify the court by letter, within 21 days, of the correct substitute party. See Fed. R. App. P. 43(c).
