ORDER FILED. Considering appellants response to the August 27, 2025 order, this appeal is limited to reviewing the denial of a preliminary injunction in the district courts June 17, 2025 and July 21, 2025 orders. The clerk will strike the opening brief filed November 4, 2025 (Docket Entry No. 7) and supplemental opening brief filed November 14, 2025 (Docket Entry No. 11). The motion (Docket Entry No. 10) to file the oversized brief is denied as moot. The replacement pro se opening brief in this preliminary injunction appeal is due December 30, 2025. The answering brief is due January 27, 2026. The optional pro se reply brief is due 21 days after the answering brief is served. Appellant is not required to submit excerpts of record. ORDER FILED. Appellant Seantain Cook, prison identification number 149256, is proceeding in forma pauperis and has filed the form authorizing prison officials to assess, collect, and forward to the district court the fees for this appeal. See 28 U.S.C. 1915(b)(1) and (2). This court assesses an initial filing fee that equals 20 percent of the greater of: (A) the average monthly deposits to appellants prison trust account; or (B) the average monthly balance in appellants account for the six months preceding July 23, 2025, when the notice of appeal was filed. Payments will not be made when funds in the account total less than $10, but payments will resume when funds become available. The clerk will serve this order and the authorization form on the Attorney General for the State of AZ who must notify the agency or prison authority responsible for administering payments for this appeal. See 28 U.S.C. 1915(b)(2). Each payment should be accompanied by the district court and appeals court docket numbers for this case and a record of prior payments made for this appeal. ORDER FILED. The court has received appellants motion to clarify (Docket Entry No. 4). The notice of appeal filed in the district court on July 23, 2025 challenges the district courts orders entered June 17, 2025, June 30, 2025, and July 21, 2025. The notice of appeal filed in the district court on July 29, 2025 specifically challenges the portions of the June 17, 2025, and July 21, 2025 district court orders denying appellants motion for a preliminary injunction, and was filed in this docket as an amended notice of appeal. Within 21 days, appellant must file a statement explaining why the scope of this appeal should not be limited to reviewing the denial of a preliminary injunction. If appellant does not do so, the appeal will proceed as a preliminary injunction appeal, and the court will set a new briefing schedule pursuant to Ninth Circuit Rule 3-3. If appellant files a statement, appellees may file a response within 10 days. Briefing is stayed. Appellant was permitted to proceed in forma pauperis in the district court. That status continues in this court because it has not been revoked. See Fed. R. App. P. 24(a).
