ORDER FILED. (Ryan D. NELSON, Jennifer SUNG, Holly A. THOMAS) The opening brief was due September 15, 2025. Appellant did not file the opening brief. Instead, on September 12, 2025, appellant filed a motion (Docket Entry No. 8) indicating that he wishes the court to consider the filings in support of the emergency motion (Docket Entry Nos. 4, 5, 6, & 7) as the opening brief. Upon review of the record and appellants submissions in this docket, we conclude that the questions raised in this appeal are so insubstantial as not to require further argument. See United States v. Hooton, 693 F.2d 857, 858 (9th Cir. 1982) (stating standard for summary affirmance); see also 28 U.S.C. 1443, 1455; California v. Sandoval, 434 F.2d 635, 636 (9th Cir. 1970) (stating standard for removal under 28 U.S.C. 1443). The district courts July 9, 2025 and July 10, 2025 orders are affirmed.
