Date Filed Document Text
February 9, 2026 Filing 8 MANDATE ISSUED Richard R. CLIFTON, Andrew D. HURWITZ, Daniel A. BRESS. The judgment of this Court, entered 12/18/2025, takes effect this date. [Entered: 02/09/2026 09:40 AM]
December 18, 2025 Opinion or Order Filing 7 ORDER FILED. (Richard R. CLIFTON, Andrew D. HURWITZ, Daniel A. BRESS) A district courts dismissal order is not final or immediately appealable under 28 U.S.C. 1291 unless it disposes of all claims as to all parties or unless judgment is entered in compliance with Federal Rule of Civil Procedure 54(b). Romoland Sch. Dist. v. Inland Empire Energy Ctr., LLC, 548 F.3d 738, 747 (9th Cir. 2008) (citing Chacon v. Babcock, 640 F.2d 221, 222 (9th Cir. 1981)). [A] plaintiff, who has been given leave to amend, may not file a notice of appeal simply because he does not choose to file an amended complaint. A further district court determination must be obtained. WMX Techs., Inc. v. Miller, 104 F.3d 1133, 1136 (9th Cir. 1997); see also 28 U.S.C. 1291; Green v. Occidental Petroleum Corp., 541 F.2d 1335, 1338 (9th Cir. 1976) (district court must be of the opinion that the criteria of section 1292(b) are met; court of appeals is without authority to assume an appeal unilaterally). This court lacks jurisdiction over this appeal because the September 29, 2025 order granted leave to amend some claims. This appeal is therefore dismissed. See 9th Cir. R. 3-6(b) (if court determines it lacks jurisdiction, court may dismiss appeal without notice or further proceedings). DISMISSED. [Entered: 12/18/2025 01:54 PM]
November 14, 2025 Filing 6 On November 13, 2025, the court issued a global order resetting the non-jurisdictional filing deadlines for federally funded attorneys (including FPDs and CJA counsel), that had been stayed by the courts October 1, 2025 Supplemental Administrative Order. If your deadlines were suspended by the October 1 Administrative Order, please review the #Order Resetting Deadlines, available on the courts website, to find your new deadlines. [Entered: 11/14/2025 04:59 PM]

October 16, 2025 Opinion or Order Filing 3 ORDER FILED. 1291. This court may therefore lack jurisdiction over this appeal. Within 21 days, appellant must either file a motion to voluntarily dismiss this appeal or file a statement explaining why it should not be dismissed. If appellant does not do so, the court will dismiss the appeal. See 9th Cir. R. 42-1. If appellant files a statement, appellees may file a response within 10 days. Briefing is stayed.
