ORDER FILED. Appeal Nos. 24-6927 and 24-7290 are cross-appeals challenging the district courts October 16, 2024 order. The first and second briefs on cross-appeal have been filed. The third brief on cross-appeal remains due December 15, 2025. The optional cross-appeal reply brief is due 21 days after the third brief on cross-appeal is served. The court has granted petition No. 25-5134, which sought permission to appeal the district courts October 16, 2024 order under 28 U.S.C. 1292(b). As a result of the order granting petition No. 25-5134 the court has opened a separate appeal, No. 25-6815. The fees for appeal No. 25-6815 remain due. Within 14 days, appellants must pay $605 to the district court and file proof of payment in this court. See Fed. R. App. P. 5(d)(1). If appellants do not do so, the court will dismiss appeal No. 25-6815. See 9th Cir. R. 42-1. The parties will submit separate briefing for appeal No. 25-6815. The briefs in appeal No. 25-6815 may, however, reference the briefs and excerpts of record in cross-appeal Nos. 24-6927 and 24-7290. The opening brief for appeal No. 25-6815 is due January 20, 2026. If supplemental excerpts of record are necessary for appeal No. 25-6815, they are also due January 20, 2026. The answering brief is due February 19, 2026.
