ORDER FILED. The request for a certificate of appealability (Docket Entry Nos. 5, 6) is granted with respect to the following issue: whether the trial court violated appellants Confrontation Clause and due process rights by its handling of the victims testimony, including whether appellant established prejudice. See 28 U.S.C. 2253(c)(3); see also 9th Cir. R. 22-1(e). Solomon Wollack is relieved from representing appellant on appeal. See 9th Cir. R. 4-1(c). The court appoints counsel for appellant under the Criminal Justice Act. See 18 U.S.C. 3006A. Within 14 days of identifying counsel, the appointing authority for the Eastern District of California is requested to send counsels contact information to [email protected]. The opening brief is due July 21, 2026. The answering brief is due August 20, 2026. The optional reply brief is due 21 days after the answering brief is served. The clerk will serve this order on former counsel Wollack and on appellant Randy Scroggins (CDCR No. BM-3561), individually, at California Health Care Facility, Stockton, P.O. Box 213040, Stockton, CA 95213. If Steve Smith is no longer the appropriate appellee in this case, counsel for appellee must notify the court by letter, within 21 days, of the correct substitute party. See Fed. R. App. P. 43(c).
