In appeal No. 25-460, appellant challenges the denial of a motion to seal the same information at issue in this appeal. The record in No. 25-460 demonstrates that the subject material has been provisionally sealed pending that appeal. Given the pendency of No. 25-460, the motion (Docket Entry No. 3) for injunctive relief is granted. See Feldman v. Ariz. Secy of State, 843 F.3d 366, 367 (9th Cir. 2016) (The standard for evaluating an injunction pending appeal is similar to that employed by district courts in deciding whether to grant a preliminary injunction.); see also Winter v. Natural Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (defining standard for preliminary injunction in district court). The Tax Court is directed to seal any docket entries in Nos. 23354-21 and 19159-23 that disclose appellants returns or return information covered by 26 U.S.C. 6103, pending resolution of this appeal. The Tax Court may require appellant to submit redacted versions for public filing. We expedite this appeal. The opening brief is due January 13, 2026. The answering brief is due February 9, 2026. The optional reply brief is due 14 days after the answering brief is served. No streamlined extensions of time to file a brief will be approved. See 9th Cir. R. 31-2.2(a)(1).
