ORDER FILED. Appellant Tanya Delgadillo Nareau, prison identification number 260586, is proceeding in forma pauperis and has filed the form authorizing prison officials to assess, collect, and forward to the district court the fees for this appeal. See 28 U.S.C. 1915(b)(1) and (2). This court assesses an initial filing fee that equals 20 percent of the greater of: (A) the average monthly deposits to appellants prison trust account; or (B) the average monthly balance in appellants account for the six months preceding February 3, 2025, when the notice of appeal was filed. Payments will not be made when funds in the account total less than $10, but payments will resume when funds become available. The clerk will serve this order and the authorization form on the Attorney General for the State of Arizona who must notify the agency or prison authority responsible for administering payments for this appeal. See 28 U.S.C. 1915(b)(2). Each payment should be accompanied by the district court and appeals court docket numbers for this case and a record of prior payments made for this appeal. ORDER FILED. Appellants response to this courts February 13, 2025 order to show cause attests that appellant delivered the notice of appeal to prison authorities within 30 days after entry of the district courts judgment. See 28 U.S.C. 2107(a); Fed. R. App. P. 4(a)(1)(A), (c)(1). Accordingly, the order to show cause is discharged. Appellant was permitted to proceed in forma pauperis in the district court. That status continues in this court because it has not been revoked. See Fed. R. App. P. 24(a). Even so, the full $605 in fees for this appeal will be collected when adequate funds are available in appellants prison trust account. See 28 U.S.C. 1915(b)(1), (b)(2). Within 21 days, appellant must complete the enclosed authorization form and file it with this court. If appellant does not do so, the court will dismiss the appeal. See 9th Cir. R. 42-1. Briefing remains stayed until the court decides appellants motion for appointment of counsel. The clerk will serve this order and a prisoner authorization form on appellant. ORDER FILED. The notice of appeal was not received by the district court within 30 days after the district court entered judgment on December 2, 2024. See 28 U.S.C. 2107(a); Fed. R. App. P. 4(a)(1)(A). The court may therefore lack jurisdiction over this appeal. See United States v. Sadler, 480 F.3d 932, 937 (9th Cir. 2007) (requirement of timely notice of appeal is jurisdictional). A pro se prisoners notice of appeal is deemed filed when deposited in the institutions internal mail system if appellant submits sufficient evidence. See Fed. R. App. P. 4(c)(1); Houston v. Lack, 487 U.S. 266, 270 (1988). Within 21 days, appellant must file a declaration or notarized statement attesting to the date the notice of appeal was deposited and whether first-class postage was prepaid. See Fed. R. App. P. 4(c)(1); Douglas v. Noelle, 567 F.3d 1103 (9th Cir. 2009). If appellant does not do so, the court will dismiss this appeal. See 9th Cir. R. 42-1. Briefing is stayed.
