ORDER FILED. Appellant Morriss opposed motion (Docket Entry No. 8) to stay this appeal to pursue relief in state court under Cruz v. Arizona, 598 U.S. 17 (2023), and State v. Anderson, 547 P.3d 345 (Ariz. 2024) and State v. Traverso, 576 P.3d 97 (Ariz. 2025), is granted as follows. (1) Within 30 days of this order, Morris must: (a) initiate post-conviction proceedings in state court; and (b) file a status report in this appeal (25-7976) showing he has done so. (2) Morriss federal counsel is authorized to represent Morris in the state court proceedings. (3) Within 14 days after the state courts final resolution of Morriss post- conviction petition, the parties must each file a status report or move for other appropriate relief in 25-7976.
