SANCHEZ The motion (Docket Entry No. 16) to dismiss this appeal for lack of jurisdiction is denied without prejudice to renewing the arguments in the answering brief. See Natl Indus. v. Republic Natl Life Ins. Co., 677 F.2d 1258, 1262 (9th Cir. 1982) (merits panel may consider appellate jurisdiction despite earlier denial of motion to dismiss). The motion (Docket Entry No. 4) for injunctive relief is denied. See Feldman v. Ariz. Secy of State, 843 F.3d 366, 367 (9th Cir. 2016) (The standard for evaluating an injunction pending appeal is similar to that employed by district courts in deciding whether to grant a preliminary injunction.); see also Winter v. Natural Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (defining standard for preliminary injunction in district court). The motion (Docket Entry No. 19) to stay pending appeal is denied. See Nken v. Holder, 556 U.S. 418, 434 (2009) (defining standard in the context of staying lower court order or judgment). The motion (Docket Entry No. 20) to expedite is denied. The opening brief has been filed.
