March 31, 2026 Opinion or Order Filing 19 NOTICE OF ORAL ARGUMENT on Tuesday, April 7, 2026 - 10:00 A.M. - Courtroom 2 - Scheduled Location: San Francisco CA View the Oral Argument Calendar for your case #here. NOTE: Although your case is currently scheduled for oral argument, the panel may decide to submit the case on the briefs instead. See Fed. R. App. P. 34. Absent further order of the court, if the court does determine that oral argument is required in this case, you are expected to appear in person at the Courthouse. If an in person appearance would pose a hardship, you must file a motion for permission to appear remotely by video, using ACMS filing type Motion to Appear Remotely for Oral Argument. Such a motion must be filed within 7 days of this notice, absent exigent circumstances. Please note that if you do file a motion to appear remotely, the court strongly prefers video over telephone appearance. Therefore, if you wish to appear remotely by telephone you will need to justify that request in your motion and receive explicit permission to do so. Be sure to review the #GUIDELINES for important information about your hearing. If you are the specific attorney or self-represented party who will be arguing, use the ACKNOWLEDGMENT OF HEARING NOTICE filing type in ACMS no later than 28 days before the hearing date. No form or other attachment is required. If you will not be arguing, do not file an acknowledgment of hearing notice. [26-1575] [Entered: 03/31/2026 05:01 PM]

March 25, 2026 Opinion or Order Filing 9 ORDER FILED. Kenneth K. LEE, Ana DE ALBA, Eric C. TUNG (Dissent by Judge de Alba) The court has received the governments emergency motion for a stay pending appeal, which includes a request for an immediate administrative stay pending full review of the emergency motion for a stay pending appeal. Dkt. No. 3. The request for a temporary administrative stay is GRANTED. An administrative stay is intended to minimize harm while an appellate court deliberates and lasts no longer than necessary to make an intelligent decision on the motion for stay pending appeal. United States v. Texas, 144 S. Ct. 797, 798-99 (2024) (Barrett, J., concurring). An administrative stay does not constitute in any way a decision as to the merits of the motion for a stay pending appeal. Doe #1 v. Trump, 944 F.3d 1222, 1223 (9th Cir. 2019). We defer weighing the Nken factors until the motion for stay pending appeal is considered. Natl Urb. League v. Ross, 977 F.3d 698, 702 (9th Cir. 2020) (footnote omitted). Here, the administrative stay is granted to maintain the status quo. The court orders expedited briefing for the motions to stay pending appeal and to stay district court proceedings. The response is due March 26, 2026 at 5:00 PM PST. The optional reply is due April 1, 2026 at 5:00 PM PST. Oral argument for this case and Dickinson, et al. v. Trump, et al. will be consolidated and will occur on April 7, 2026 at 10:00 AM PST. The argument will be heard virtually via Zoom. [Entered: 03/25/2026 04:31 PM]
