ORDER FILED. Lisa B. Fitzgerald, Appellate Commissioner. Counsel Jesse Ortiz represented appellant in the district court and has not been granted leave to withdraw. Although appellant filed a pro se notice of appeal, Ortiz continues as appellants counsel on appeal. See 9th Cir. R. 4-1(a). Within 14 days, counsel must either file a motion to withdraw that complies with Ninth Circuit Rule 4-1(c) or file a notice that he intends to remain counsel of record. Counsel Ortiz is directed to include in the motion or statement a response to appellants assertions in the pro se notice of appeal (District Court Docket Entry No. 49) regarding counsels failure to file a timely notice of appeal. The notice of appeal was not deposited in the prisons internal mail system within 30 days after the district court entered judgment on March 24, 2025. See 28 U.S.C. 2107(a); Fed. R. App. P. 4(a)(1)(A). The court may therefore lack jurisdiction over this appeal. See United States v. Sadler, 480 F.3d 932, 937 (9th Cir. 2007) (requirement of timely notice of appeal is jurisdictional). Within 35 days, appellant must either file a motion to voluntarily dismiss this appeal or file a statement explaining why it should not be dismissed. If appellant does not do so, the court will dismiss the appeal. See 9th Cir. R. 42-1. If appellant files a statement explaining why the appeal should not be dismissed, appellee may file a response within 10 days. Briefing is stayed.
