Edward Macklin has filed a 28 U.S.C. 2254 habeas petition that challenges Macklins Santa Barbara County Superior Court conviction in Case No. 22CR02144. Macklin currently has a pending 28 U.S.C. 2254 habeas corpus petition in United States District Court for the Central District of California Case No. 2:25-cv-06594-CBM-MAR that challenges this same conviction. When a habeas petition is filed in the court of appeals, the application must be transferred to the appropriate district court. Fed. R. App. P. 22(a); see 28 U.S.C. 1631, 2241(b). The clerk will transfer the petition at Docket Entry No. 1 to the United States District Court for the Central District of California Case No. 2:25-cv-06594-CBM-MAR, for whatever consideration that court deems appropriate. This transfer order is issued without regard to whether petitioners claims have any merit or satisfy the procedural requirements of 28 U.S.C. 2244(d) and 2254. The clerk will include a copy of this order with the transferred petition. The clerk will send a copy of this order and the petition to Judge Marshall and Judge Rocconi.
