ORDER FILED. (Andrew D. HURWITZ, Lawrence VANDYKE, Jennifer SUNG) In this appeal from the district courts order of detention pending sentencing, we have jurisdiction under 18 U.S.C. 3145(c) and 28 U.S.C. 1291. Appellants emergency motion (Docket Entry No. 4) to stay the district courts order for voluntary surrender is denied. See Nken v. Holder, 556 U.S. 418, 433-34 (2009). The motion to vacate the district courts detention order is denied without prejudice to renewal in the district court. See 18 U.S.C. 3143(a) (the judicial officer shall order that a person awaiting sentencing be detained unless the judicial officer finds by clear and convincing evidence that the person is not likely to flee or pose a danger to the safety of any other person or the community if released). Appellant may file a new appeal, if necessary, following the district courts resolution of any such motion. See Fed. R. App. P. 9(b). DISMISSED. [Entered: 09/04/2026 12:26 PM]
