HURWITZ) Stephen Russell Fegan has filed a 28 U.S.C. 2254 habeas petition that challenges Fegans 1995 Merced County Superior Court conviction for two counts of first-degree special circumstances murder, first-degree burglary, arson of an inhabited structure, and child abduction in Case No. SUF18939. We do not transfer the petition to the district court because Fegan challenged this conviction in a 2254 petition in Case No. 1:99-cv-06427-OWW-LJO in the United States District Court for the Eastern District of California, and the district court adjudicated the petition on the merits and entered judgment on January 7, 2003. Fegan must first obtain authorization from this court to file a second or successive 2254 petition. See 28 U.S.C. 2244(b)(3)(A). We express no opinion as to whether Fegan will be able to satisfy the requirements of 2244(b)(2). The clerk will close this original action. Any pending motions are denied as moot.
