Upon consideration of plaintiffs Motion to Expedite, ECF No. 8, and defendant's Response thereto, ECF No. 9, the court denies plaintiffs Motion to Expedite. Defendant states in its Response that it intends to file its Answer to the Complaint by the April 8, 2024 deadline. Def.'s Resp. Pl.'s Mot. Exp. at 1, ECF No. 9. Until defendant files an Answer, the court does not deem that it has the necessary facts to decide whether the instant action merits precedence over other actions. USCIT Rule 3(g)(3) states that the court on motion for good cause... may expedite... an action described in 28 U.S.C. 1581(a) to contest the denial of a protest, in whole or in part, under section 515 of the Tariff Act of 1930, involving the exclusion or redelivery of merchandise USCIT R. 3(g)(3) (emphasis supplied). Aside from stating that the subject merchandise "has an expiration date," plaintiff has not shown or iterated reasons that the court should expedite the instant action. Pl.s Mot. Exp. at 1, ECF No. 8. In the absence of good cause from plaintiff and defendant's opposition to expediting the action, the court denies plaintiffs motion without prejudice. SO ORDERED.
