March 3, 2009 Opinion or Order Filing 254 FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDERS CONCERNING THE DEFENDANT JONATHAN CURSHEN. Curshen and his officers, agents, servants, employees, representatives, etc. are permanently restrained and enjoined from employing any device, scheme or a rtifice to defraud, etc. as set forth in the Order. Curshen is barred from participating in any penny stock offering in accordance with § 15(b)(6)(A) of the Exchange Act. Judgment shall enter against Defendant Curshen in the amount of $66 ,235, together with prejudgment interest to be determined as hereafter provided. Final judgment shall enter but the Court retains jurisdiction to implement and carry out the terms of all orders and decrees as well as consider any application or moti on for additional relief. The SEC may file request for determination of prejudgment interest and imposition of a civil penalty on or before April 15, 2009. The Defendant may respond on or before May 6, 2009 and the SEC may reply 10 days thereafter. No pleading shall exceed 10 pages on these issues, by Judge Walker D. Miller on 3/3/09. (ebs, )
