REPORT AND RECOMMENDATION that 166 Plaintiff's MOTION for Summary Judgment Pursuant to Fed. R. Civ. P. 56 be denied and that 171 Defendants' Combined MOTION for Summary Judgment be granted and that summary judgment enter in favor of the defendants on all of the plaintiff's claims.
