August 14, 2009 Opinion or Order Filing 74 REPORT AND RECOMMENDATIONS OF UNITED STATES MAGISTRATE JUDGE: The Court RECOMMENDS that Defendants 53 Motion for Summary Judgment and Supporting Brief be GRANTED in part as to the withholding of the six-page ADX staff roster pursuant to Claim II. T he Court further RECOMMENDS that Defendants Motion be DENIED in part without prejudice as to the adequacy of Defendant BOPs records search pursuant to Claim II.
