SUPPLEMENTAL ORDER RE: RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE. The Federal Bureau of Prisons is an agency of the United States Department of Justice. In the context of the plaintiffs claims in this case, the Federal Bureau of Prisons an d the United States Department of Justice are, in essence, the same entity. This order is to correct my oversight in failing to address the plaintiffs claims against the Federal Bureau of Prisons. The Recommendation of United States Magistrate Judge 104, filed04/19/2010, is APPROVED AND ADOPTED. The objections in Defendants Partial Objection to Magistrate Judges Recommendation 106, filed 05/03/2010, are SUSTAINED. The objections in plaintiffs Objections to Recommendations of UnitedStates Magistr ate Judge 121, filed 07/16/2010, are OVERRULED. Plaintiffs Motion for Judgment as a Matter of Law 81, filed 10/01/2009, is GRANTED IN PART and DENIED IN PART. Defendants Supplemental Motion for Summary Judgment 88, filed 11/06/2009, is GRANTED IN PAR T, DENIED AS MOOT IN PART. Claims I, III, IV, VI, VII, and VIII of the Amended Complaint 4, filed 11/17/2010, are DISMISSED WITH PREJUDICE. Claim V of the Amended Complaint 4, filed November 17, 2010, is DISMISSED WITHOUT PREJUDICE. REPORT AND RECOMMENDATIONS OF UNITED STATES MAGISTRATE JUDGE: The Court RECOMMENDS that Defendants 53 Motion for Summary Judgment and Supporting Brief be GRANTED in part as to the withholding of the six-page ADX staff roster pursuant to Claim II. T he Court further RECOMMENDS that Defendants Motion be DENIED in part without prejudice as to the adequacy of Defendant BOPs records search pursuant to Claim II. The Court further RECOMMENDS that Defendants Motion be GRANTED as to Claims I, III, IV, V , VI, VII and VIII. The Court further RECOMMENDS that the parties bear their own costs. Finally, in the event that the District Court accepts the above Recommendation and denies Defendants Motion without prejudice with respect to the adequacy of Defe ndant BOPs records search pursuant to Claim II, the Court further RECOMMENDS that the dispositive motions deadline be extended to thirty (30) days after the District Courts ruling.
