March 10, 2011 Opinion or Order Filing 313 OPINION AND ORDER GRANTING, IN PART, MOTION FOR RECONSIDERATION, GRANTING DEFENDANTS' MOTION FOR SUMMARY JUDGMENT, AND DENYING MOTION FOR LEAVE TO AMEND. Defendants' 250 Motion for Summary Judgment is DENIED AS MOOT. Defendants' [28 2] Second Motion for Summary Judgment is GRANTED, and the Clerk of the Court shall enter judgment in favor of Defendants Nafziger, Osagie, and Amirkahn on all claims in this action. Mr. Bradshaw's 293 Motion to Correct Dual Filing Fee Fundamen tal Unfairness is DENIED. The 295 Plaintiffs' Motion for Reconsideration of the Court's 09/07/2010 280 Opinion is GRANTED IN PART, insofar as the Court has reconsidered its prior decision in light of the arguments raised in the motion, but DENIED IN PART, insofar as, upon reconsideration, the Court finds that its previous rulings were sound. Mr. Bradshaw and former Plaintiff Mr. Tuttamore's 300 Motion For Certification of Judgments Pursuant to Fed. R. Civ. P. 54(b) is DENIED AS MOOT. The Plaintiffs' 303 Objections to the 11/01/2010 298 Recommendation of the Magistrate Judge are OVERRULED, the Court ADOPTS that Recommendation, and the 272 Plaintiffs' Motion to Amend the Complaint is DENIED. Mr. Bradshaw&# 039;s 306 Motion for Leave to File Affidavit and Medical Records is and Mr. Bradshaw's 312 Motion to File Supplemental Records are DENIED AS MOOT. September 7, 2010 Opinion or Order Filing 280 OPINION AND ORDER GRANTING PARTIAL SUMMARY JUDGMENT TO DEFENDANTS. The 140 Plaintiffs' Motion to Consolidate Cases is GRANTED. The case of Bradshaw v. Leyba, D.C. Colo. Civ. Case No. 08-cv-02542-PABKLM is CONSOLIDATED into this action. Becaus e the claims in that action are identical to those asserted here, the Clerk of the Court shall close that case. The Court ADOPTS the 203 Magistrate Judge's Recommendation and the Plaintiffs' Motion for Entry of Default (# 152 , as supple mented # 180 , 181 ) are DENIED. The 172 Plaintiffs' Motion for Summary Judgment is GRANTED IN PART, insofar as the Court finds that there is no genuine dispute of material fact requiring trial with regard to the Plaintiffs' IFRP claims , and DENIED IN PART, insofar as the Court finds that Defendants Collins, Sudlow, Knox, Madison, Foster, and Finlan are entitled to judgment against the Plaintiffs on all claims asserted against them in the Amended Complaint. The caption of this case is AMENDED to omit these Defendants and to omit Mr. Tuttamore as a Plaintiff. The 253 Plaintiffs' Objections to the 247 Magistrate Judge's Recommendation are OVERRULED and the Court ADOPTS that Recommendation. The claims against Defend ant Leyba are DISMISSED without prejudice for failure to effect timely service pursuant to Fed. R. Civ. P. 4(m) and D.C. Colo. L. Civ. R. 41.1. The caption of this case shall is AMENDED to omit Mr. Leyba. The motions at Docket # 232 , 233 , 243 , 263 , and 265 are DENIED AS MOOT. Mr. Tuttamore's 277 Motion to Withdraw is GRANTED, and the 226 Motion is DEEMED WITHDRAWN. Pursuant to the Order at Docket # [86 ]in Case No. 08-cv-02546, the remaining claims against Defendants Lappin an d Wiley are DISMISSED, and the caption of this case is AMENDED to omit Mr. Lappin and Mr. Wiley. The Court finding that there is no just reason for delay in entering judgment in favor of the Defendants mentioned herein pursuant to Fed. R. 27 Civ.
