August 10, 2009 Opinion or Order Filing 32 REPORT AND RECOMMENDATIONS re: Pattersons Motion for Entry of Default and Default Judgment Pursuant to F.R.C.P. 55(b) 25 and LINAs Unopposed Motion to Dismiss and to Disburse Funds from the Registry of the Court 30 be GRANTED. Default judgment be entered against Defendant Debra Ann Hale and in favor of Defendant Elva Joanne Patterson. The amount of $2,570.66 be distributed from the Courts Registry to Life Insurance Company of North America. The remaining proceeds of the insurance policy , which have been deposited into the Registry of the Court, be paid to Defendant Patterson in the sum certain of $26,814.22. Defendant Debra Ann Hale be restrained from instituting any action against Plaintiff LINA affecting the life insurance benefits that are being paid to Defendant Patterson.
