ORDER AWARDING EXPENSES AND DISMISSING CASE re: 38 Plaintiff's Supplemental Support for Request for Fees; 39 Defendants' Joint Status Report. Plaintiff shall be reimbursed $6156.04 from the interpled funds contained in the Court&# 039;s registry. The Clerk is directed to remit such amount to Plaintiff at Evans & MacFarland, LLC. The remaining interpled funds (including the principle and interest), minus the registry fee assessment, shall be transferred to the registry for the Douglas County District Court. Plaintiff's claims are dismissed with prejudice. Defendants' cross-claims are dismissed without prejudice. After payment is made to Plaintiff and transfer of the remaining interpled funds has been effected, the Clerk shall close this case, by Magistrate Judge Kristen L. Mix on 12/16/2010. (wjc, )

ORDER granting 23 Plaintiff's Motion for Dismissal with Prejudice and Award of Fees and Costs. Plaintiff shall be dismissed with prejudice and awarded its reasonable expenses incurred in this matter. However, due to Plaintiff's failure t o provide sufficient information regarding the reasonableness of its expenses, the amount of the award shall be determined at a later date. Prior to dismissal taking effect, and within 10 days of this Order, Plaintiff shall file additional informati on that it would like the Court to consider regarding the expenses incurred. Any response in objection to the reasonableness of Plaintiff's submission shall be filed within 10 days of such submission. No reply will be permitted. Within 10 days of this Order, Defendants shall file a joint status report addressing their positions regarding the three issues set forth in more detail, by Magistrate Judge Kristen L.
