ORDER. ORDERED as follows: Based on Plaintiffs' concession, their claim for fraud (Claim 11) is dismissed with prejudice and Wright Medical is entitled to summary judgment on Plaintiffs' claims for negligence per se (Claim 9), negligent mi srepresentations (Claim 8), strict product liability due to non conformance with representations (Claim 3), and violations of the Colorado Consumer Protection Act (Claim 10). Wright Medical is also entitled to summary judgment on Plaintiffs' cla ims alleging strict product liability based on a manufacturing defect (Claim 1), strict product liability for failure to warn (Claim 4) to the extent that claim is based on pre-surgery warnings, negligent failure to warn (Claim 5) to the extent that claim is based on pre-surgery failure to warn, breach of express warranties (Claim 6), and breach of implied warranties (Claim 7). Plaintiffs' objections to the magistrate judge's recommendation to deny their motion to amend the complaint are OVERRULED.
