OPINION AND ORDER DENYING DEFENDANT LOPEZ'S MOTION FOR SUMMARY JUDGMENT, AND GRANTING IN PART AND DENYING IN PART DEFENDANT ASPEN VALLEY HOSPITAL'S MOTION FOR SUMMARY JUDGMENT: Defendant John A.
