Mr. Rader's Renewed Motion to Dismiss Counterclaims 52 is GRANTED IN PART, insofar as EPS' second counterclaim, sounding in libel, is DISMISSED without prejudice, with EPS granted 10 days from the date of this Order to file a motion seeking leave to replead that counterclaim, and DENIED IN PART, insofar as the Court finds that EPS' first counterclaim, sounding in breach of contract for Mr. Rader's disclosure of confidential information, facially states a claim.
