ORDER ADOPTING AND AFFIRMING 62 JUNE 21, 2012 RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE. Defendants Shears and Dawson's 17 Motion to Dismiss is granted. Defendant Jefferson County Correction Board's 24 Motion for Summary Judgm ent is granted and all claims against Defendant Jefferson County Correction Board be dismissed with prejudice. Plaintiff's 38 Motion for Preliminary Injunction is denied as moot. Defendants Wischmeier and Quintana's 43 Motion to Dismis s is granted. Defendant Community Corrections Board's 48 Motion to Dismiss or in the Alternative for More Definitive Statement be denied. However, it is ordered that the Amended Complaint be dismissed as against this Defendant pursuant to 28 U .S.C. § 1915(e)(2)(B)(ii). Plaintiff's 60 Motion to Dismiss Any "Takings" Procedural Due Process Claimis granted. Pursuant to 28 U.S.C. § 1915(a)(3), any appeal from this Order wouldnot be taken in good faith, and thus, such an appeal may not be taken in forma pauperis.
