Filing 53 MEMORANDUM OPINION AND ORDER Mr. Krutsinger's Amended Petition for a Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2254 (ECF No. 24 ) is DENIED. Under 28 U.S.C. § 2253(c), a petitioner may not appeal the denial of his habeas appli cation without a certificate of appealability. I conclude Mr. Krutsinger has made a substantial showing of the denial of a constitutional right on his fourth claim. Thus, a certificate of appealability is GRANTED for Mr. Krutsinger's first and fourth claims and DENIED for his second and third claims, by Judge John L. Kane on 10/28/2020. (evana, ) |
