Filing 42 Memorandum Opinion and Order. The United States Postal Services Motion to Dismiss the Plaintiffs' antitrust claims is GRANTED on the ground that the USPS is not a person under the Meyer standard or the PAEA based on its conduct in imposing o r altering the terms of its contracts with CPUs. While the USPSs conduct in changing the playing field with regard to blank label roll sourcing and IGI's strong-arm tactics in getting CPUs to purchase those rolls at supracompetitive prices ma y subject either or both to othercauses of action under the PAEA or other statutory or common law theories of relief, they do not subject either to antitrust liability on the grounds alleged. Because IGI's Motion to Dismiss is premised on the same immunity defense as the USPSs, that Motion is now MOOT and is DENIED as such. Counsel shall CONFER and SUBMIT a Joint Status Report on or before July 19, 2013, on how they wish to proceed in light of the Court's ruling by Judge John L. Kane on 07/03/13.(jjhsl, ) |
