Filing 19 ORDER MODIFYING RULE 16 PROCEDURE - ERISA Because this is an action brought under the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. § 1132(a)(1)(B), no scheduling conference under Fed.R.Civ.P. 16(b) and D.C.COLO.LCivR 16. 1 is necessary, and this Court's Procedural Order Number One 18 entered on December 21, 2015, is vacated. On or before January 21, 2016 counsel for the parties shall file a joint statement. If there is disagreement, the Court will set a conference to resolve the disputes, by Judge Richard P. Filing 18 PROCEDURAL ORDER NUMBER ONE Counsel will meet and confer as required by Rule 26 (f)(2) within 30 days from the date of this order. Lead counsel shall attend the conference in person. The disclosures required by Rule 26(a)(1)(A) shall be made with in 14 days after that conference. The proposed discovery plan will be in the form of the Scheduling Order which will be submitted to chambers in paper form 10 days before the date of the Scheduling Conference. Counsel for the plaintiff will telep hone chambers within 10 days after the disclosures to set a date and time for a Scheduling Conference pursuant to Rule 16.
