April 5, 2017 Opinion or Order Filing 102 ORDER: Upon consideration of Plaintiff's "Motion for Extension of Time to File Objections to Report and Recommendation [ECF No. 87]" (the "Motion") #94 , the same is DENIED. The record shows the following. CSU-Pueblo Defendants requested an extension of time to file objections #89 ; they asked Plaintiff if he had any objection to the extension; and Plaintiff did not and it was so represented to the Court. The Court granted CSU-Pueblo Defendants an extension and no one else. No one else asked for an extension. Subsequently, after the deadline for objections had passed, Plaintiff filed his Motion. In the Motion, Plaintiff stated that, due to an "inadvertent error," his counsel read the Court's order as granting an extension to all parties. It is unclear which of Plaintiff's counsel read the Court's order in that manner - was it one or was it all? Plaintiff is represented by two law firms, one in Colorado and one in New York. Regardless, assuming all counsel read the Court's order erroneously, Plaintiff's counsel argues excusable neglect and requests the Court to grant an extension now. Federal Defendants object to the requested extension of time; after all, the Report and Recommendation recommends granting Federal Defendants' Motion to Dismiss. Federal Defendants' objection raises a number of grounds for denial of the Motion, such as prejudice, but it is the objection based on the Motion's "mischaracterization of the email correspondence" between the parties which causes the Court to pause the longest. The Court recognizes that errors occur, despite the best efforts and diligence of counsel, and there are occasions where such errors may-and should-be excused. The Court finds, however, that candor to the Court should neither be wanting, nor excused. Here, in paragraph 11 of the Motion, Plaintiff represented that, in the email exchange involving CSU-Pueblo Defendants' counsel request for an extension of time, "[a]s Plaintiff likewise required additional time to file an objection to the Report and Recommendation, Plaintiff's counsel indicated that they would not oppose such a request, understanding that they would be afforded a reciprocal courtesy. Counsel for the Federal Defendants did not oppose this request for an extension of time, as to either party." The record is to the contrary. CSU-Pueblo Defendants' email did not request whether Federal Defendants opposed their -or anyone else's - request for an extension of time; nor did Federal Defendants respond or state they did not oppose. In fact, Federal Defendants did not reply at all as no one asked for their consent. This is confirmed by CSU-Pueblo Defendants' motion for extension of time #89 which states "Plaintiff's counsel advised they do not object to the request for relief stated herein." (Emphasis added.) No mention was made at all as to Federal Defendants. On this record, the Court finds excusable neglect has not been shown and the Motion #94 is DENIED. SO ORDERED by Judge Raymond P. July 6, 2016 Opinion or Order Filing 24 MINUTE ORDER: This matter is before the Court on the parties' Notice of Voluntary Dismissal pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i) #21 , giving notice of the agreed upon dismissal, without prejudice, of Defendants Catherine Lhamon and John B. King, Jr., in their individual capacities. The parties cite to Fed. R. Civ. P. 41(a)(1)(A)(i) for the dismissal of actions in support of their Notice of dismissal of two of the defendants, and only in their individual capacities. There is, however, uncertainty in the Tenth Circuit whether Fed. R. Civ. P. 21 ("On motion or on its own, the court may at any time, on just terms, add or drop a party.") or 41 (providing for the dismissal of an action) applies to the dismissal of a party from an action involving more than one defendant. See Van Leeuwen v. Bank of Am., N.A., 304 F.R.D. 691, 69297 (D. Utah 2015); see also Gobbo Farms & Orchards v. Pool Chem. Co., 81 F.3d 122, 123 (10th Cir. 1996) (Rule 41 "speaks of dismissal of an action, not just a claim within an action. [Plaintiff] offers no authority, and we have found none, to support its contention that Rule 41(a) applies to dismissal of less than all claims in an action."). Moreover, pursuant to Rule 15, dismissal of a party may be had by an amendment of the complaint. Regardless, the Court agrees that, in most instances (such as the Notice at issue), it is immaterial if dismissal is had under Rule 21 or 41. 9 Charles Alan Wright et al., Federal Practice and Procedure 2362 (3d ed. 2008). Accordingly, the Court FINDS the Notice is effective and ORDERS that the names of Defendants Catherine Lhamon and John B.
