RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE by Magistrate Judge Nina Y. Wang on 3/5/2018. This court respectfully RECOMMENDS that Defendant United Fire & Casualty Company's Motion to Dismiss 12 be GRANTED. ALTERNATIVELY, to the extent th e presiding judge, the Honorable Christine M. Arguello, finds that the court has subject matter jurisdiction over some, but not all, of Plaintiffs' claims in this matter, this court respectfully RECOMMENDS that this matter be ADMINISTRATIVELY CLOSED, subject to reopening for good cause, pending the disposition of Defendant United Fire & Casualty Company's appeal to the Colorado Court of Appeals.
