MINUTE ORDER: This miscellaneous case was reassigned to this Court on January 30, 2017. A non-party, David Clement, seeks an order quashing a subpoena issued by a private arbitrator in Illinois requiring that he appear for a deposition, originally set for January 24, 2017, but later extended by agreement to on or before February 7, 2017. Plaintiff requests an expedited hearing. Mr. Clement opposes that request. First, the Court advises the parties and Mr. Clement that its daughter is an employee of the law firm representing the plaintiff, which also happens to be a law firm in which I was a partner, although I have been gone from that firm for more than 18 years. My daughter is not a lawyer and works in the firm's marketing area. While I do not believe that her work at the firm would affect me at all, I will disqualify myself if requested by either party or by Mr. Clement. Second, I will be out of the office on vacation from January 31 through February 11, returning to the office on Tuesday, February 14, 2017. Therefore, unless your schedule can be further adjusted, the matter would have to be referred to another judge or magistrate judge.
