The Court CERTIFIES a FLSA Collective Action class defined as follows: All persons who worked as, or who were hired to be, a Field Investigator, Background Investigator, or in other position with similar job duties, for Defendant KeyPoint Government Solutions, Inc. at any time from April 6, 2015 to September 18, 2019. 5. Plaintiffs' Amended Motion for Rule 23 Class Certification (ECF No. 355 ) is DENIED; and 3 The Court presumes familiarity with the February 4, 2021 Order. (ECF No. 294 .) 6. Counsel shall jointly contact the chambers of Magistrate Judge N. April 12, 2024 Opinion or Order Filing 412 ORDER GRANTING DEFENDANT KEYPOINT GOVERNMENT SOLUTIONS, INC.'S MOTION TO COMPEL ARBITRATION OF CALIFORNIA STATE LAW CLAIMS AND STRIKE RELATED RULE 23 CLASS ACTION ALLEGATIONS. The Court ORDERS that KeyPoint's Motion to Compel Arbitration of California State Law Claims and Strike Related Rule 23 Class Action Allegations (ECF No. 278 ) is GRANTED. The Court further ORDERS the 31 California Plaintiffs who signed arbitration agreements to arbitrate their claims, consistent with the Arbitrator Decides Clause. KeyPoint's Amended Motion for Decertification (ECF No. 353 ) is DENIED. Plaintiffs' Amended Motion for Final Certification of the FLSA Collective (ECF No. 356 ) is GRANTED. The Court CERTIFIES a FLSA Collective A ction class as defined herein. Plaintiffs' Amended Motion for Rule 23 Class Certification (ECF No. 355 ) is GRANTED. The Court CERTIFIES a Rule 23 Class with the definition stated herein. Plaintiffs Dana McCarthy and Adriana Ponce are hereby APPROVED as Rule 23 class representatives. Pursuant to Federal Rule of Civil Procedure 23(g), the Court APPOINTS Nichols Kaster, PLLP as class counsel. Plaintiffs shall file a revised proposed Rule 23 class notice on or before April 22, 202 2. On or before April 29, 2022, the parties shall confer and file a joint statement regarding a proposed schedule for dissemination of the notice of the Rule 23 class in accordance with Federal Rule of Civil Procedure 23(c)(2).
