Defendant The Law Company, Inc. has submitted a filing (Dkt. #32) conceding that one of the members of Defendant DEN ALF 1, LLC is a limited liability company with Colorado citizenship. Pursuant to well-established Tenth Circuit precedent, see, e.g., Siloam Springs Hotel, L.L.C. v. Century Sur. Co., 781 F.3d 1233 (10th Cir. 2015), Defendant DEN ALF 1, LLC will be deemed to be a citizen of Colorado for the purposes of the Court's diversity jurisdiction analysis. As such, under the "local defendant rule," which provides that a "[a] civil action otherwise removable solely on the basis of the jurisdiction under section 1332(a) of this title may not be removed if any of the parties in interest properly joined and served as defendants is a citizen of the State in which such action is brought," 28 USC 1441(b)(2), the instant matter was not removable. The Motion to Remand (Dkt. #20) therefore is GRANTED. The lawsuit is remanded back to the District Court, City and County of Broomfield, Colorado.
