June 27, 2019 Opinion or Order Filing 75 ORDER denying #74 Motion for Leave: The motion is denied for at least three separate reasons. First, the certification pursuant to D.C. Colo. L. Civ. R. 7.1(a) is inadequate. The record reflects that the Plaintiffs filed the instant motion only 13 minutes after e-mailing the Defendants. Local Rule 7.1(a) requires more than such a token effort. Second, the motion fails to attach a proposed amended pleading as required by D.C. Colo. L. Civ. R. 15.1(b). Third, to the extent the Plaintiffs rely upon the Amended Complaint #9 as it currently exists, that document fails to adequately allege facts showing complete diversity of citizenship. The Complaint alleges the state of citizenship of the Plaintiffs (California and Texas) and the citizenship of Ms. Wardell (Colorado, although that assertion is apparently disputed according to the record), and the citizenship of Vectrus, Inc. (Indiana and Colorado), but fails to allege any facts regarding the citizenship of Vectrus System Corporation. The only allegation as to that Defendant is that it is a "wholly owned subsidiary of Vectrus, Inc." Ownership and citizenship are not necessarily connected -- a wholly-owned subsidiary may still be a citizen of different states that its parent corporation. Accordingly, the Amended Complaint fails to adequately allege a basis for the exercise of diversity jurisdiction. For these reasons, the Plaintiffs' motion is denied without prejudice. The court applauds the efforts of Plaintiffs' counsel to plan ahead rather than waiting until the last minute. The court finds good cause exists to extend the deadlines within the Scheduling Order. A motion for summary judgment was filed 6/17/2019 and is not briefed, there are several other motions pending, and an unplanned distraction has occurred in the form of Plaintiff Burton's daughter's death. Given the loss of Plaintiff Burton's attention and the difficulty with scheduling matters in June even without that situation, in addition to the likelihood acknowledged by counsel for Defendants that a few things may need to be rescheduled in August (Resp. at 4), the court will extend the deadlines within the Scheduling Order by 30 days.
