Filing 40 ORDER TO SHOW CAUSE: This matter comes before the Court upon review of the file. The Court notes that the complaint that opened this case was filed on April 19, 2019. ECF No. 1. Subsequently, an amended complaint was filed April 29, 2019 at ECF No. 18. In July 2019 by stipulation of the parties, defendants Mark Silen and Mark Silen d/b/a Hippie Dip Inc. (Silen Defendants) were dismissed with prejudice, and the Silen Defendants counterclaims against plaintiff were similarly dismissed with prejudice. In August 2019 a clerks entry of default entered as to defendant Global Visions LLC, but the Court notes that plaintiff has made no application for default judgment. It appears that the remaining defendant, Shawn Adamson, was finally served by substitute service on September 27, 2019. See ECF No. 39. Mr. Adamsons answer would have been due by October 18, 2019, however, there has been no further activity in the case.
