ORDER GRANTING IN PART AND DENYING IN PART #17 Motion to Substitute Party. Pursuant to Fed. R. Civ. P. 25(d), "when a public officer who is a party in an official capacity... ceases to hold office while the action is pending. The officer's successor is automatically substituted as a party." Accordingly, the Motion is GRANTED insofar as it seeks to substitute Dean Williams in his official capacity as Executive Director of the Colorado Department of Corrections for Defendant Rick Raemisch, the former Executive Director of the Colorado Department of Corrections. Accordingly, IT IS ORDERED that the Clerk of Court shall substitute Dean Williams, in his official capacity for Rick Raemisch, in his official capacity.IT IS FURTHER ORDERED that the Motion is DENIED insofar as it seeks to substitute Dean (I) Williams in his individual capacity for Defendant Rick (I) Raemisch in his individual capacity. Plaintiff brought this action against Defendant Rick (I) Raemisch as an individual for, presumably, his individual conduct giving rise to the claims against him. The fact that he ceases to hold office does not create sufficient grounds for substitution of parties. Similarly, Dean Williams assuming office does not mean that he becomes responsible for the individual actions of alleged against Defendant Rick (I) Raemisch. For these reasons, the Court finds no grounds to substitute Dean (I) Williams for Defendant Rick (I) Raemisch in their respective individual capacities.
