Filing 18 ORDER GRANTING [ECF. #14 & #16 ] Motions for Leave to File Amended Complaint. The Court construe's a pro se Plaintiff's filings liberally. See Smith v. United States, 561 F.3d 1090, 1096 (10th cir. 2009). Plaintiff has filed two Motions for Leave to Amend Complaint pursuant to Fed. R. Civ. P. 15(a)(2) and 19(a)(2). The Court notes that Plaintiff's Motions seek to make corrections to the Complaint and provide a name to a Jane Doe Defendant. The Court finds these amendments to be good cause for granting leave to amend. Accordingly, the Motions are GRANTED. IT IS ORDERED that Plaintiff shall file an Amended Complaint by 8/9/2019.Plaintiff is noticed of the following: (1) Future motions to amend shall clearly state the reasons justice requires the amendment. See Fed. R. Civ. P. 15(a)(2); and (2) the Amended Complaint supersedes and supplants the original Prisoner Complaint [ECF. #1 ] and the Court will no longer look to the Prisoner Complaint for purposes of determining whether Plaintiff has met her pleading standard. Therefore, Plaintiff must restate all allegations she seeks to bring in this matter in the Amended Complaint. SO ORDERED by Magistrate Judge S. Kato Crews on 7/31/2019. Text Only Entry (skclc2) |
