June 14, 2019 Opinion or Order Filing 3 ORDER TRANSFERRING CASE. This matter is before this Court on the Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2254 (ECF No. #1 ) that Applicant submitted pro se to this Court on June 13, 2019. Applicant is in the custody of the New Mexico Department of Corrections and currently is incarcerated at the Northeast New Mexico Detention Facility in Clayton, New Mexico. The Court finds that this action could, and should, have been brought in the United States District Court for the District of New Mexico, the judicial district, where the Second Judicial District Court is located and Applicant was convicted. See 28 U.S.C. 111. The Court also finds that it would be in the interest of justice to transfer this case to the District of New Mexico rather than to dismiss it. Accordingly, it is ORDERED that the Clerk of the Court transfer this action to the United States District Court for the District of New Mexico pursuant to 28 U.S.C. 1406(a), by Judge Lewis T.
