June 24, 2019 Opinion or Order Filing 5 ORDER REMANDING ACTION: The Court sua sponte and summarily remands this action to the Colorado County Court for Denver County. Mr. Tatten has previously attempted to remove the exact same underlying proceedings to this Court, see D.C. Colo. Case No. 19-cv-00039, and this Court has previously remanded the case back for lack of subject-matter jurisdiction. It is clear from the attachments to Mr. Tatten's Notice of Removal in the instant matter that the same underlying state proceeding, Denver County Court Case No. 18-cv-336, is implicated in this case as well. Thus, Mr. Tatten's Notice of Removal here is a frivolous and dilatory attempt to evade the consequences of this Court's prior remand Order. No further proceedings in this matter are required or warranted.
