MINUTE ORDER On September 16, 2019, the Court issued an Order Directing Plaintiff to File Amended Complaint within 30 days. (ECF No. #13 ). On September 26, 2019, Plaintiff filed a (Second) Motion to Clarify the September 16 Order (ECF No. #20 ) stating his intent to sue a prison physician who was not listed in the case caption of his original Prisoner Complaint. The (Second) Motion to Clarify (ECF No. #20 ) is GRANTED insofar as Plaintiff is directed to add the new Defendant to the case caption in the amended Prisoner Complaint. Plaintiff is reminded that his motions to clarify do not substitute for the filing of an amended pleading. Plaintiff shall file an Amended Prisoner Complaint in compliance with the September 16 Order within 30 days from the date of this minute order. ORDER that the Prisoner's Motion and Affidavit for Leave to ProceedPursuant to 28 U.S.C. 1915 (ECF No. #4 ) is GRANTED. That Plaintiff may proceed in this action without payment of an initial partial filing fee. That Plaintiff's custodian shall disburse from Plaintiff's inmate account monthly payments of 20 percent of the preceding month's income credited to this inmate account until Plaintiff has paid the total filing fee of $350. See 28U.S.C. 1915(b)(2). Interference by Plaintiff in the submission of these funds will result in the dismissal of this action. that Plaintiff's custodian shall continue to disburse monthly payments from Plaintiff's inmate account until full payment of the filing fee has been paid to the Court, even after disposition of the case and regardless of whether relief is granted or denied. That the request for appointment of counsel (ECF No. #5 ) is DENIED WITHOUT PREJUDICE as premature.
