ORDER that the Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 (ECF No. #3 ) is GRANTED. That, within thirty (30) days of the date of this Order, Plaintiff's custodian shall disburse from Plaintiff=s prison account, if funds are available in keeping with 28 U.S.C. 1915(b), an initial partial filing fee of $2.55 to the Clerk of the United States District Court for the District of Colorado, which represents 20 percent of the greater of the (1) average monthly deposits, or (2) average monthly balance in Plaintiff's prison accounts for the six-month period immediately preceding the filing of the Complaint. That Plaintiff's custodian shall continue to disburse monthly payments from Plaintiff's inmate account until full payment of the filing fee has been paid to the Court, even after disposition of the case and regardless of whether relief is granted or denied. That the Clerk of the Court shall send a copy of this Order to Draper Prison/Utah State Prison, P.O. Box 250, 14425 Bitterbush Lane, Draper, UT 84020-0250. MINUTE ORDER On September 17, 2019, the Court issued an Order Directing Plaintiff to Cure Deficiency (ECF No. #5 ) instructing Plaintiff to submit a certified copy of his trust fund statement for the 6-month period immediately preceding this filing as part of the Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 form. On October 10, 2019, Plaintiff filed two documents requesting an extension of time to cure the designated deficiency. (ECF Nos. #7 and #8 ). Plaintiff will be granted an extension of time to comply with the September 17 Order by submitting within 30 daysfrom the date of this minute order, a certified copy of his account statement. If jail officials are interfering with his ability to provide a certified copy of his inmate trust fund account statement showing activity for the six months preceding his filing, Plaintiff must notify the Court, by the deadline, and provide detailed information to show the interference of jail officials with his ability to comply. In addition, "a request for a court order must be made by motion." Fed. R. Civ. P. 7(b)(1).
