November 4, 2019 Opinion or Order Filing 19 ORDER TO SHOW CAUSE: The Court has a duty to sua sponte consider its subject matter jurisdiction. Fed. R. Civ. P. 12(h)(3). Defendant claims jurisdiction pursuant to 28 U.S.C. 1332 based on the diversity of the parties. The Court "must rigorously enforce Congress' intent to restrict federal jurisdiction in controversies between citizens of different states." Martin v. Franklin Capital Corp., 251 F.3d 1284, 1289 (10th Cir. 2001), abrogated on other grounds by Dart Cherokee Basin Operating Co., LLC v. Owens, 135 S. Ct. 547 (2014). Defendant states that "if Plaintiff proves his damages are equal to or exceed the $100,000 policy limits, proves he is entitled to benefits under the policy, and proves those benefits were unreasonably delayed and denied, he is entitled to collect the policy limits of $100,000, plus two times the covered benefit, equaling a total of $300,000, plus attorney fees" and that the "amount [Plaintiff] will request in attorney fees is certain to exceed $75,000." (Doc. No. 1, 13-14); however, Plaintiff's Complaint lacks factual allegations that plausibly allege that the amount in controversy exceeds $75,000. See 28 U.S.C. 1332(a). Moreover, though a defendant may support its removal notice by reference to a plaintiff's check mark on the Colorado civil cover sheet, Paros Properties LLC v. Colorado Cas. Ins. Co., 835 F.3d 1264, 1272 (10th Cir. 2016) (citations omitted), in this case the plaintiff specifically did not check the box indicating that her suit seeks more than $100,000. Accordingly, Defendant is ORDERED TO SHOW CAUSE in writing, by November 15, 2019, as to why the Court should not remand this case to the El Paso County Court for lack of diversity jurisdiction over this matter.
