Filing 78 This matter is before the Court on Defendant's Motion for Judgment on the Pleadings #51 and Plaintiff's Cross-Motion for Leave to Amend #57 . The latter was filed in derogation of Local Rule 7.1(d) because it was included in Plaintiff's response opposing the Motion for Judgment on the Pleadings. D.C.COLO.LCivR 7.1(d) ("A motion shall not be included in a response or reply to the original motion. A motion shall be filed as a separate document."). Future motions filed in derogation of Local Rule 7.1(d) will be summarily dismissed. This single occasion, however, the Court entertains Plaintiff's cross-motion in accordance with Fed. R. Civ. P. 1.Leave to amend "shall be freely given when justice so requires." Frank v. U.S. W., Inc., 3 F.3d 1357, 1365 (10th Cir. 1993). Here, the Court finds good cause for granting the cross-motion and allowing the amendments in light of the intervening law. The Court makes no conclusions at this stage as to whether the intervening law itself supports the amendments; the Court merely concludes leave to amend shall be allowed under the circumstances presented here.Plaintiff's Cross-Motion for Leave to Amend #57 is GRANTED. Defendant's Motion for Judgment on the Pleadings is DENIED AS MOOT. Plaintiff is ORDERED to file a clean copy of the amended complaint within 10 days from the date of this Order.
