The Court is sympathetic to Defendant's desire and entitlement to move this case toward resolution; however, in light of the seriousness of Mr. Padilla's condition, its opposition to resetting the conference is both extraordinary and confounding. Considering the representations in the Motion, the Court can see little utility in convening a conference at this time. February 22, 2021 Opinion or Order Filing 48 ORDER re #43 Motion for Extension of Time. Federal Rule of Civil Procedure 16(b)(4) provides a Scheduling Order may be modified only for good cause. "Rule 16(b) does not focus on the bad faith of the movant, or the prejudice to the opposing party. Rather, it focuses on the diligence of the party seeking leave to modify the scheduling order to permit the proposed amendment. Properly construed, 'good cause' means that scheduling deadlines cannot be met despite a party's diligent efforts." Pumpco, Inc. v. Schenker Int'l, Inc., 204 F.R.D. 667, 668 (D. Colo. 2001). In her Motion, Plaintiff seeks an extension of the expert deadlines. The Court notes, however, Plaintiff is not seeking additional time to give a retained expert an opportunity to review deposition testimony and prepare a report. Rather, Plaintiff has not even decided whether she will retain such an expert. Indeed, Mr. Vogel's deposition was completed on February 11, 2021. But even in her Reply filed on February 18, 2021, Plaintiff still could not definitively state whether she actually intends to hire an expert. Sans that specificity, Plaintiff's requested relief is too amorphous to justify an extension of the deadlines. Even if the Court were to conclude otherwise, Plaintiff has not demonstrated diligence. Plaintiff does not dispute she has been in possession of Mr. Vogel's report for two years. Given this, Plaintiff has not sufficiently explained why, at minimum, she couldn't even determine whether she would retain an expert to opine on investigatory procedures for sexual harassments complaints. Further, it is not entirely clear--given Mr. Vogel is a non-party fact witness who is not employed with the City--why Plaintiff could not have at least initiated conversations with Mr. Vogel regarding scheduling his deposition. Finally, Defendants aptly note Plaintiff seeks to extend the expert deadline as to the designation of any and all experts. In the Scheduling Order, Plaintiff stated she anticipates calling experts "in the fields of psychology, psychiatry, sexual assault victim behaviors, economics, accounting, and damages." But she has offered no explanation as to why she has not been able to meet the deadline with respect to these other types of experts. In her Reply, she simply reiterates her request to extend the deadline as to all expert designations. That is insufficient. A scheduling order is not a frivolous piece of paper, idly entered, which can be cavalierly disregarded by counsel without peril.
