July 6, 2020 Opinion or Order Filing 14 ORDER DENYING AS MOOT #13 Motion to Dismiss. Pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, a Plaintiff may voluntarily dismiss a matter without Court order by filing a "stipulation of dismissal signed by all parties who have appeared." Fed. R. Civ. P 41(a)(1)(A)(ii). The parties filed a "Stipulated Motion for Dismissal with Prejudice" [#13 ]. Therein, the Parties stipulate to dismissal of the case with prejudice, and all parties that have appeared signed the document. [See #13 .] The document seeks dismissal under Rule 41. [Id.] Despite it being styled as a Motion, the Court construes Docket No. #13 as Plaintiffs' voluntary dismissal. Accordingly, the matter was dismiss with prejudice at the time of filing. See Fed. R. Civ. P. 41(a)(1)(A)(ii). It follows that, to the extent Plaintiffs move the Court for dismissal, that request is moot. For these reasons, IT IS ORDERED that the matter was dismissed with prejudice by Plaintiffs' voluntary dismissal, pursuant to Rule 41(a)(1)(A)(ii). IT IS FURTHER ORDERED that, to the extent Plaintiffs move the Court for dismissal, the Motion is DENIED AS MOOT. IT IS FURTHER ORDERED that the Clerk of Court shall close this matter.
