Filing 11 MINUTE ORDER: This matter is before the Court upon review of the amended complaint #10 in which Plaintiff alleges subject matter jurisdiction under 28 U.S.C. 1332. For diversity jurisdiction to exist, this action must be between citizens of different states and the amount in controversy must "exceed[] the sum or value of $75,000, exclusive of interest and cost." 28 U.S.C. 1332(a). Here, the amended complaint alleges that "[t]he matter in controversy now between diverse parties may or may not be in excess of $75,000 exclusive of interest and costs pursuant to 28 U.S.C. 1332 depending on contentions of the defendant." (ECF No. 8, ¶ 4 (emphasis added).) Plaintiff, however, is the master of her complaint and the existence of such jurisdiction must generally appear on the face of her complaint. See generally Hansen v. Harper Excavating, Inc., 641 F.3d 1216, 1220 (10th Cir. 2011) (existence of federal question must appear on face of complaint, federal defense is insufficient). Thus, Plaintiff's allegations are insufficient to show the Court has subject matter jurisdiction. It is therefore ORDERED that on or before Friday, June 26, 2020, Plaintiff shall SHOW CAUSE why this action should not be dismissed without prejudice based on lack of subject matter jurisdiction.
